Terms of Service for Airborne Vistas LLC

1. Introduction

I, Airborne Vistas (“Company,” “we,” or “us”), provide these Terms of Service (“Terms”) to govern your use of my services. By accessing or using my services, you (“Client,” “you,” or “your”) agree to be bound by these Terms.

2. Services

I offer a variety of videography and photography services, including:

  • Real estate photography
  • Weddings and events
  • Product photography
  • Time-lapses
  • Videography for marketing purposes
  • Virtual tours

A detailed description of the services included in each package will be provided in a separate agreement or proposal.

3. Booking and Payment

To book a service, you must contact me and confirm the project details, like date, location, and desired services.

A deposit of 50% is required to secure your booking date. The remaining balance is due after project completion and deliverables have been met.

I accept payment via Credit Card and Debit Card.

4. Cancellation and Rescheduling

I understand that circumstances may change, so here’s my cancellation policy:

  • Cancellations made more than 48 hours before the event will receive a full refund of the deposit.
  • Cancellation made with less than 48 hours before the event will receive a 40% refund of the total cost. This reflects the 50% deposit required at booking to reserve your spot.
  • Cancellation made within 24 hours of the scheduled session/flight will not be eligible for a refund.
  • Rescheduling may be possible based on my availability and may incur additional fees.

I reserve the right to cancel the project due to unforeseen circumstances, such as severe weather or illness. In such cases, I will provide a full refund of any payments received.

5. Scope of Work

The specific details of each project, including deliverables, timeline, and any additional fees, will be outlined in a separate agreement or proposal.

I will do my best to capture high-quality images and videos according to your requests and my creative vision. However, I cannot guarantee specific results or styles.

Any revisions to the scope of work after the initial agreement may incur additional fees.

6. Copyright and Use of Materials

I retain the copyright to all original photographs and videos I create.

I grant you a non-exclusive, royalty-free license to use the delivered photographs and videos for personal and non-commercial purposes.

Any commercial use of the materials requires my written permission and may involve additional licensing fees.

7. Your Responsibilities

You are responsible for:

  • Obtaining any necessary permits or permissions for the photoshoot or video shoot (not including airspace approval).
  • Providing me with access to the location and any necessary props or equipment.
  • Being on time and prepared for the photoshoot or video shoot (if required).
  • Cooperating with me and following my instructions during the shoot (if present).

8. Liability

I am not liable for:

  • Any loss or damage to your personal property during the photoshoot or video shoot.
  • Any delays or cancellations caused by factors beyond my control, such as weather or acts of God.

My total liability to you for any claim or loss arising under these Terms will not exceed the total amount paid by you for the services.

9. Confidentiality

I will maintain the confidentiality of all information you provide me, including your personal information and the details of your project.

10. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of Utah.

Any dispute arising out of or relating to these Terms will be resolved through [dispute resolution method, e.g., mediation, arbitration]. You (“Client,” “you,” or “your”) will be responsible for both parties filing fees, legal representation costs, and arbitrator’s fees and expenses, if applicable.

11. Entire Agreement

These Terms constitute the entire agreement between you and me regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

12. Amendment

I reserve the right to modify these Terms at any time without prior notice. The revised Terms will be effective upon posting on my website.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
